How Long Do Arrests Stay on Your Record?

Arrests typically remain indefinitely on a subject’s criminal record unless they are sealed or expunged. However, arrest records are retained in a local law enforcement agency’s internal files for durations specified by the Kentucky Local Government General Records Schedule. According to the schedule, arrest records for adult felony and misdemeanor offenses are maintained for 80 and 5 years, respectively. Meanwhile, juvenile arrest files may be retained until the record’s subject turns 23, and mugshots are retained for 80 years.

Expunge Taylor County Arrest Records

Expungement is a legal procedure that removes an arrest, charge, or conviction from an individual’s criminal record. In Taylor County, an individual's arrest record may be eligible for automatic expungement if it resulted in a case dismissed with prejudice/acquittal on or after July 15, 2020. In other cases, individuals can petition to seek expungement of their arrest record. In such cases, they must apply for an expungement certification for the arrest records they wish to expunge per KRS 431.079. The certificate proves that the arrest record in question is eligible for expungement.

The Kentucky State Police (KSP) and the Kentucky Administrative Office of the Courts (AOC) oversee the expungement certification application process. Interested individuals can apply online, in person, or by mail. Prospective petitioners can utilize the Kentucky Court of Justice registration website for online applications. To access the website, they must create an account using their active email address. Once logged in, they can complete the online expungement certification application, submit it, and pay a required $40 request fee. Subsequently, they will receive a notification about when their certification packet will be available online through the email address they provided. On the date specified in the notification, an applicant can log in to the Kentucky Court ofJustice registration website and download the certification packet.

On the other hand, prospective petitioners can use the Expungement Certification Request Form to apply for an expungement certification either in person or by mail. The request form must be accurately completed and submitted along with a $40 request fee in person at the drive-thru window of the Administrative Office of the Courts. For mail-in requests, send the completed request form and the required fee payment (via check or money order payable to the Kentucky State Treasurer) to:

After processing and approving the request, the AOC will send an expungement certification packet to the applicant via U.S. mail.

If a petitioner has received an expungement certification for an arrest record, they can request expungement by submitting an expungement petition and paying the required fee to the Taylor County Circuit Clerk’s Office. Different expungement petition forms are available depending on the statute (KRS 431.073, KRS 431.076, or KRS 431.078) under which their arrest record qualifies for expungement. Additionally, the accompanying fees vary.

KRS 431.073

An arrest that resulted in certain felony convictions is eligible for expungement under KRS 431.073. In this case, the form to use is Form 496.3, which is subject to a $50 non-refundable filing fee. Upon approval, there is an additional $250 expungement fee to complete the process.

KRS 431.076

Arrest records that fall under any of the following categories are eligible for expungement under KRS 431.076 using form 497.2:

  • Arrests that resulted in an acquittal (provided charges were dismissed but not in exchange for a guilty plea to another charge)
  • Arrests that resulted in felony charges that did not result in an indictment.

KRS 431.078

An arrest qualifies for expungement under KRS 431.078 using Form 496.2 if it resulted in a conviction of certain misdemeanors, violations, or traffic infractions, and the following is true:

  • The arrest does not involve a sexual offense or an offense against a minor.
  • The applicant was not convicted of a felony or misdemeanor in the past five (5) years before filing the expungement petition.
  • There are no pending proceedings against the applicant concerning a felony or misdemeanor offense.
  • The applicant's offense can not be enhanced to a second or subsequent offense, or the time limit for such an enhancement has passed.

After the Taylor County Circuit Clerk receives an expungement petition, prosecutors are allowed 60 days to file objections. In cases where the prosecutor files an objection, the clerk will schedule a hearing and notify the applicant. Conversely, the court can issue an expungement order without a hearing if the prosecutor does not file an objection.

Taylor County Arrest Warrants

A Taylor County arrest warrant is a court-issued directive instructing law enforcement officers to arrest a specific individual suspected of committing a crime. A judge or magistrate has the authority to issue an arrest warrant. Typically, law enforcement agencies request arrest warrants through sworn statements or testimonies presented to a judge or magistrate. These sworn statements or testimonies must provide evidence demonstrating sufficient probable cause linking the individual to the alleged crime. According to Kentucky Court Rules 2.06, an arrest warrant must be in writing, in the name of the Commonwealth of Kentucky, and include the following details:

  • The issuance date
  • The issuing officer's signature and their office’s title
  • Description of the alleged offense and the court where it occurred
  • The defendant’s name (if known) or a description that can be used to identify them with reasonable certainty.

Do Taylor County Arrest Warrants Expire?
