Nelson County Arrest Records Vs. Criminal Records

The following eligibility requirements must be fulfilled for a court to authorize the expungement of qualifying records.

  • Neither an offense against a minor nor a sexual offense was the reason for the petitioner's arrest.
  • Five (5) years had passed since the petitioner's last felony or misdemeanor conviction when the expungement petition was filed.
  • There are no proceedings against the petitioner for felony or misdemeanor offenses.
  • Either the time restriction for such an augmentation has gone away, or the petitioner's offense cannot be enhanced to a second or subsequent offense.
