Expunge Greenup County Arrest Records

Expungement is a legal process that removes an arrest, charge, or conviction from a subject's record. Generally, arrest records are automatically expunged after 30 days if the case resulted in a dismissed case with prejudice/acquitted on or after July 15, 2020. For other cases, the first step in seeking an arrest record expungement is to apply for an expungement certification per KRS 431.079. This certificate establishes that a record is eligible for expungement. The Kentucky State Police (KSP) and the Kentucky Administrative Office of the Courts (AOC) oversee the application process for an expungement certification, and there are three main ways to apply: online, in-person, or by mail.

To apply for an expungement certification online, interested persons can visit the Kentucky Court of Justice registration site and register using their active email address. Subsequently, they can log into the site, complete the online request form for an expungement certification, and pay the required $40 request fee. After that, applicants will receive a notification about when their certification packet will be available online through the email they use during their registration. On receiving the notification, applicants can revisit the Kentucky Court of Justice registration site, log in, and download the certification packet.

Subsequently, the AOC will process the request, and upon approval, they will mail an expungement certification packet to the applicant by U.S. mail.

After receiving an expungement certification, an applicant can request expungement of their arrest record, which is subject to the certification, through the Greenup County Circuit Clerk's office. To do this, an applicant can complete the appropriate expungement petition form and submit it, along with their expungement certification and the required fee(s), to the Greenup County Circuit Clerk's office. The expungement petition form and the required fee(s) vary based on the statute (KRS 431.073, KRS 431.076, or KRS 431.078) under which the applicant's arrest record qualifies for expungement.

KRS 431.073

Arrests that led to certain felony convictions can be petitioned for expungement under KRS 431.073 using form 496.3. Note that a $50 non-refundable filing fee is due when filing the form 496.3. If the petition gets approved, there is an additional $250 expungement fee to complete the expungement process.

KRS 431.076

Arrest records can be petitioned for expungement under KRS 431.076 using form 497.2, provided they fall under any of the following categories:

  • Arrests that resulted in an acquittal (provided charges were dismissed but not in exchange for a guilty plea to another charge)
  • Arrests that resulted in felony charges that did not result in indictment

KRS 431.078

Arrests that resulted in conviction of certain misdemeanors, violations, or traffic infractions can be petitioned for expungement under KRS 431.078 using form 496.2 provided the following criteria are met:

  • The arrest did not stem from a sexual offense or an offense against a minor.
  • The applicant had not been convicted of a felony or misdemeanor in five (5) years prior to filing the expungement petition.
  • The applicant has no pending proceedings concerning a felony or misdemeanor offense.
  • The applicant's offense can not be enhanced for a second or subsequent offense, or the time limit for such an enhancement has passed.

Generally, after an expungement petition is filed, prosecutors are allowed 60 days to object to it. If the prosecutor files an objection, the court will schedule and send notice of a hearing to the applicant. However, the court may issue an order granting an expungement petition without a hearing if the prosecutor does not file an objection.

Greenup County Arrest Warrants

A Greenup County arrest warrant is a court order directed to law enforcement officers that grants them the authority to arrest an individual. A judge or magistrate can issue an arrest warrant at the request of law enforcement, provided they demonstrate that sufficient probable cause exists via a sworn statement that an individual has committed a crime. The sworn statement must contain evidence or testimony establishing a connection between the suspect and the crime in question. According to Kentucky Court Rules 2.06, an arrest warrant must be in writing, in the name of the Commonwealth of Kentucky, and contain the following:

  • The date of issuance
  • Description of the alleged offense and the county where it occurred
