Dismissal or acquittal - no waiting period. The arrestees can petition for the expunging of records immediately after the pronouncements.
Misdemeanor Conviction - 5 years after completing the sentence for the offense (including probation and parole)
Class D Felonies - 5 years after completing the sentence, probation, and parole (if applicable)
Dismissal without prejudice or as part of a diversion program - 1 year from the date of dismissal or completion of a diversion program
Traffic Offenses - 5 years after completing the sentence
In addition to the conditions above, a petitioner must not have any conviction or charges within the waiting period. Also, individuals have a lifetime limit of one felony expungement.
