Expunge Bullitt County Arrest Records
Expungement is a legal process that removes an arrest, charge, or conviction from an individual's record. Per KRS 431.079, one of the first steps in applying for an arrest record expungement is to ascertain whether the record is expungable by obtaining an expungement certification.
Interested persons can request an expungement certification for the record they wish to expunge through the Kentucky Administrative Office of the Court online, in person, or by mail. Note that requesters are charged $40 for an Expungement Certification. Online requests can be made through the Kentucky Court of Justice Registration Site. Users must log in or register an account to access the site. On the other hand, in-person and mail-in requests can be made by completing the Expungement Certification Request Form and submitting it along with the $40 fee payment (via check or money order made payable to the Kentucky State Treasurer). In-person submission can be made at the drive-thru window at the Administrative Office of the Courts at 1001 Vandalay Drive, Frankfort, during regular working hours (Monday to Friday from 8 a.m. to 4 p.m. EST). After obtaining an expungement certification and depending on the details of the arrest record, an individual can file a petition under KRS 431.073, KRS 431.076, or KRS 431.078 to expunge the record. For arrests that occurred within Bullitt County, expungement petitions are filed with the Bullitt County Circuit Court. However, the eligibility requirement and form used for filing an expungement petition under each statute form vary.
Expungement petitions under KRS 431.073
An arrest record may be expungable under KRS 431.073 if the arrest resulted in most Class D felony convictions (with certain expectations) or the arrestee has been granted a full pardon for their offense. To apply for record expungement under KRS 431.073, a petitioner can complete an Application to Vacate and Expunge Felony Conviction. Next, attach the expungement certification to the completed application, file it with the Bullitt County Circuit Court, and pay the filing fee. A $50 filing fee is due when the application is filed. Subsequently, if the application is granted, the petitioner must pay a $250 expungement fee (installment payment plans are also available).
Note that prosecutors are allowed 60 days to object after a felony expungement petition is filed. If the prosecutor objects, the Bullitt County Circuit Clerk will schedule a hearing and send a notice to the petitioner. However, if the prosecutor does not object, the Circuit Court may issue an expungement order without a hearing.
Expungement petitions under KRS 431.076
Arrest records are eligible for expungement under KRS 431.076, provided the arrest resulted in:
- Order of acquittal or dismissal with prejudice
- No indictment by the grand jury or information filed by the Commonwealth's Attorney
Note that each scenario has applicable statutes of limitations. For instance, there is a 60-day statute of limitation for cases that result in an order of acquittal or dismissal with prejudice. Nonetheless, an expungement petition can be made under this statute by completing AOC-497.2 and filing it along with the expungement certification in a court of appropriate jurisdiction. Note that there is no filing fee for petitions to expunge felony charges that do not result in an indictment.
Expungement petitions under KRS 431.078
Arrest records may be expunged under KRS 431.078 if the arrest results in a conviction for certain misdemeanors, violations, or traffic infractions. To apply for an expungement under this statute, petitioners can complete form 496.2, file it along with their expungement certification with a court of appropriate jurisdiction, and pay the required filing fee.
It is worth noting that cases ending in an acquittal or dismissed on or after July 15, 2020, are automatically expunged after 30 days, excluding traffic cases. In such cases, the defendant would not need to obtain expungement certification or file an expungement petition.
Bullitt County Arrest Warrants
A Bullitt County arrest warrant is a formal court order that directs peace officers to arrest a specific individual. Per RCr 2.04, a judge or a clerk can issue an arrest warrant after examining a complaint if they find probable cause to believe that an offense has been committed and the defendant committed it.
