Boyd County Arrest Records Vs. Criminal Records
Arrest and criminal records in Boyd County serve different purposes, although they are closely related. Arrest records document the details of an individual’s arrest. These records are generated at the time of an arrest and include details such as the arrest's date, time, and location, charges or suspected offenses, information about the arresting agency, and the incident that led to the arrest. However, unlike criminal records, arrest records do not indicate guilt or conviction. Court records encompass a wider range of information, including arrests, charges filed, court proceedings, and the outcomes of those proceedings, such as dismissals, convictions, or acquittals.
How Long Do Arrests Stay on Your Record?
Arrests remain on an individual’s record until expunged. If the charge was dismissed or the individual was not indicted, they may request an expungement within 6 months. Individuals charged with a misdemeanor whose case was dismissed without prejudice can file for expungement after 1 year. Those convicted of misdemeanor offenses or Class-D felonies may request expungement an unlimited number of times, provided they wait 5 years after completing their sentence. However, the waiting period for DUI convictions is 10 years before an expungement can be requested.
Boyd County Arrest Warrants
A judge or magistrate issues arrest warrants following a request by law enforcement or prosecutors where they establish probable cause to believe the individual committed the alleged offense. A typical arrest warrant includes the following details:
- The full name and identifying information of the person to be arrested.
- The charges or allegations that warrant the arrest.
- A description of the probable cause supporting the issuance of the warrant.
- The date and signature of the issuing judge or magistrate.
- Directives and instructions for law enforcement to carry out the arrest.
- Any applicable bail/bond conditions.
Do Boyd County Arrest Warrants Expire?
In Boyd County, arrest warrants do not expire and remain legally enforceable unless the person named in the warrant is arrested, the issuing judge or magistrate recalls or cancels it, or the charges related to the warrant are dismissed.
Judicial review or procedural errors could lead to its recall and changes in the legal status of the associated charges, such as a dismissal or resolution outside of court. Until any of these conditions are met, law enforcement agencies in Boyd County retain the power to execute the warrant at any time.
